Terms and Conditions

By accessing our website and booking our orca diving tours, you agree to the following terms and conditions. Please review them carefully before making a reservation. These terms apply to all services provided by Orca Norway and are governed by Norwegian law.

Pricing and Payment

The pricing for our orca expeditions varies depending on the length of the trip and the type of boat you choose. All prices are listed in Norwegian kroner (NOK) and include all applicable taxes. Although prices may change, confirmed bookings will not be affected by future adjustments.

Non-refundable deposit:

  • NOK 8 000,- for 3-day expeditions
  • NOK 12 000,- for 6-day expeditions

Please note that deposits are non-refundable under any circumstances.

Payment Deadlines

  • October & November expeditions: Full payment due by September 1st of the same year.
  • December & January expeditions: Full payment due by October 1st of the same year.

Reservations can be made through our website or by contacting us via email. A confirmation will be sent once the deposit is received. We accept payments via credit card or bank transfer.

Failure to Pay

If full payment is not received by the deadlines (September 1st or October 1st), your booking will be automatically canceled, and the deposit will be forfeited. A reminder will be sent via email prior to cancellation, allowing time to complete the payment.

Cancellations and Booking Changes

After the payment deadlines, no changes or cancellations can be made, and no refunds will be issued. Trips can only be rebooked or postponed before the payment deadline, subject to a fee of NOK 2 500,-

  • Cancellations before the payment deadline: All payments (excluding the deposit) will be refunded.

Illness or Death in the Immediate Family

If an expedition is canceled due to illness or death in the immediate family, the amount paid (minus the deposit) will be refunded if the cancellation occurs more than one month before departure. Valid documentation (doctor’s note or death certificate) is required.

  • Cancellations within one month must be covered by the participant’s travel insurance. We strongly recommend all participants secure adequate travel insurance for such unforeseen events.

Travel Insurance

Participants are responsible for ensuring they have valid travel insurance that covers:

  • Illness, accidents, and emergency evacuation
  • Loss of luggage
  • Trip cancellations due to illness or unforeseen events

Flight and Accommodation Recommendations

We strongly recommend waiting until February 15th of the same year as the expedition to book flights and accommodations. This allows for adjustments to the expedition location, if necessary.

  • We are not responsible for non-refundable travel or accommodation costs if destination changes are communicated before February 15th.

Limitation of Liability

Orca Norway is not responsible for delays, cancellations, or events beyond our control, including:

  • Adverse weather conditions
  • Transportation issues
  • Other external factors

If we cancel an expedition due to unforeseen circumstances, you will receive a full refund or the option to reschedule. However, we are not responsible for any additional travel or accommodation expenses.

Changes to the Program

While we strive to follow the planned schedule, we reserve the right to make minor adjustments due to unforeseen circumstances. Any significant changes, such as a change in destination, will be communicated to participants as soon as possible.

Participant Responsibilities

  • Follow all instructions and safety guidelines provided by Orca Norway staff.
  • Participants must be in reasonable physical condition and able to swim, handle small boats, and tolerate cold weather.
  • Any medical conditions that may affect participation must be disclosed in advance.

We reserve the right to refuse participation or remove individuals whose behavior endangers themselves, others, or the environment.

Assumption of Risk

Orca expeditions involve inherent risks such as:

  • Unpredictable weather
  • Animal behavior
  • Maritime environments

By participating, you acknowledge and accept these risks. Orca Norway is not liable for any injuries, damages, or losses unless they result from gross negligence or willful misconduct on our part.

Force Majeure

Orca Norway is not responsible for any failure to fulfill our obligations due to causes beyond our reasonable control, such as:

  • Natural disasters
  • War or civil unrest
  • Acts of God

In such cases, deposits will be retained for use on a rescheduled expedition, or a full refund (minus the deposit) will be offered.
